ELIGIBILITY: The Farm Rich “Kids Who Give” Contest (the “Contest”) is open to all legal residents of the 50 United States and the District of Columbia, 7 to 17 years of age, except employees, officers, directors, agents (and their immediate families [spouse, parent, child, sibling and their respective spouses] and household members (whether or not related) of Rich Products Corporation (the “Sponsor”), and their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies and affiliated entities (collectively, with the Sponsor, “Contest Entities”). No purchase necessary to enter or win. Void in Puerto Rico and wherever prohibited by law. Contest is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Contest, entrants (and their parent/legal guardian, collectively the “Entrants”), agree to accept and be bound by all terms of these Official Rules and Regulations (“Official Rules”). Limit one (1) entry per person or e-mail address.
HOW TO ENTER: From 9:00 a.m. Eastern Time (“ET”) on March 1, 2011 through midnight ET on May 31, 2011 (the “Entry Period”), Sponsor will conduct a national skill contest encouraging participants to submit answers to a series of written essay questions, totaling no more than 2,000 words, based on the following weighted criteria: (i) What does the phrase “giving back” mean to you? (5%); (ii) What volunteer work have you done in your community? (20%); (iii) How long have you been involved in this effort? (5%); (iv) When and how often do you volunteer to help others? (5%); (v) Tell us about the results of your volunteer efforts. (15%); (vi) Did you help recruit others to support your cause? (5%); (vii) What inspires you to want to improve the lives of others? (10%); (viii) What have you learned from this experience? (15%); (ix) If you are selected as one of the 2011 Kids Who Give winners and you receive a donation in support of your cause, how do you plan to use those funds? (15%); (x) What advice do you have to share with other kids who are interested in spreading happiness and goodwill through community service? (5%). Participants are encouraged to include a supporting video, of no longer than three minutes in length, or photograph, as part of their submission.
To enter during the Entry Period, visit www.KidsWhoGive.com, complete the online entry form in its entirety, including written answers to the above statements/questions, along with the supporting video and photograph, and submit. (The online entry form, essay questions and supporting video or photograph will be referred to collectively as the “Submission.”) To be eligible, each Submission must be received no later than midnight ET on May 31, 2011. All Submissions must be submitted in the name of an individual person and the prize can only be awarded to the person whose name is on the winning Submission (or parent/legal guardian if winner is a minor). All Submissions must be in English.
By entering the contest, you are verifying that you are the owner and producer of the submitted material and that no third party ownership rights exist to the video or photograph submitted. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as your original work. By entering this contest, you are transferring all ownership rights of your submission to the Sponsor, as defined above. Your submission materials will not be returned and you will not be permitted to use the Submission for any video use after it has been submitted. By entering the contest, you are giving Sponsor permission to use the Submission content, including the video or photo.
Entrant warrants and represents: (a) he/she is the sole and exclusive author and owner of the Submission, including all rights therein, and that the Essay has not won any previous awards or competitions; (b) Entrant has the full and exclusive right, power and authority to submit the Submission and to grant the Contest Entities the rights to the Submission, including but not limited to the worldwide copyright; (c) no part of the Submission has been aired, and; (d) no rights in the Submission have been previously granted to any person, firm, corporation or other entity. Sponsor reserves the right in its sole discretion to disqualify any Submission at any time in the event it is determined that the Submission is offensive, inappropriate, not in keeping with Sponsor’s images or if it is determined that the Entrant has not otherwise complied with these Official Rules. If the Submission contains any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the Submission, any and all releases and consents necessary to permit the use and exhibition of the Submission by Sponsor in the manner set forth in these Official Rules. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any participant at any time.
Any Submission generated by script, macro or other automated means will be void. The Contest Entities are not responsible for incomplete, lost, late, or inaccurate entries, nor for technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems which may limit or affect a person’s ability to participate in the Contest, whether human, mechanical, printing, electronic, network or otherwise, relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of Submissions, the announcement of the prizes or in any Contest-related materials. Proof of online submission is not considered proof of delivery or receipt. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsors’ control, which corrupt the integrity, administration, security or proper operation of the Contest, Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend the Contest. In the event of cancellation, Sponsor reserves the right to judge all eligible, non-suspect Submissions received prior to the event requiring such cancellation using the judging procedure outlined below. False or deceptive Submissions or acts will render the Entrant ineligible.
Each Entrant hereby acknowledges and agrees that the relationship between Entrant and Sponsors is not a confidential, fiduciary, or other special relationship, and that Entrant’s decision to submit his/her Submission to Sponsor for purposes of the Contest does not place Sponsor in a position that is any different from the position held by members of the general public with regard to elements of Entrant’s Submission. By entering this Contest, Entrant acknowledges and agrees that Sponsor may receive many Submissions under this Contest and that such Submissions may be similar or identical in theme, idea, format or other respects to others submitted under the terms of this Contest and/or other contests staged and/or sponsored by Sponsor, and waive any and all claims entrant may have had, may have, and/or may have in the future, that any Submissions and/or other works accepted, reviewed and/or used by other Entrants and/or Sponsor (or their designees) may be similar to Entrant’s Submission. Entrant acknowledges and agrees that Sponsor has not, nor shall have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to Entrant’s Submission. All entries become the property of Sponsor and will not be returned.
CATEGORIES: All submissions should fall within one of three age categories:
HOW TO WIN/JUDGING: All eligible submissions will be received and reviewed by a judging panel who will select the contest semi-finalists.
Category Winners: The judging panel will select winners from the contest semi-finalists. Judges will select one Grand Prize winner, one First Place winner, and one Runner-Up from each category: Ages 7-10, Ages 11-13, Ages 14-17.
Fan Favorite: There will be a public viewing period, which spans June 1, 2011, through June 15, 2011, in which the entries of semi-finalists will be posted on www.kidswhogive.com for people to view and vote on a Fan Favorite. Individuals may cast one (1) vote per day during this time. If an entry receives multiple and/or irregular votes or more than 1 vote per day from the same user or users, including but not limited to, votes generated by a robotic, programmed, script, macro, other automated means, or other source, the Sponsor reserves the right to disqualify the contest Entrant at its sole discretion. By participating in the voting portion of this Contest, each voting participant agrees to be bound by these official Contest rules (“Official Rules”). The submission with the most votes will win the Fan Favorite. The Fan Favorite winner (including parent/legal guardian of minor, collectively the “Winners”) will be announced on or after August 15, 2011.
In the event of a tie, the entries involved will be re-judged by a different judge who will serve as the tiebreaker. The decision of the judges will be final and binding in all matters. The Winners will be confirmed by U.S. mail, e-mail and/or telephone and must meet all eligibility requirements including the timely execution and return of all necessary releases and documents required by Sponsors.
PLEASE NOTE: IF THE ENTRANT IS UNDER 18 YEARS OLD AT THE TIME OF FIRST NOTIFICATION, THE AWARDING OF THE PRIZE AND FURTHER PARTICIPATION IN THE CONTEST IS EXPRESSLY CONDITIONED UPON RECEIPT OF VERIFIABLE PARENTAL CONSENT WITHIN FIVE (5) BUSINESS DAYS OF E-MAIL NOTIFICATION. FURTHER DETAILS WILL BE INCLUDED IN THE PRIZE WINNER E-MAIL NOTIFICATION.
PRIZES:
Fan Favorite: One (1) Fan Favorite prize will be awarded. Fan Favorite winner will receive a $500.00 gift card for their personal use and a Farm Rich prize pack valued at approximately $300.00. Farm Rich will also provide the Fan Favorite winner with a donation check for $500 to be used to benefit local causes or charities (which can include but not be limited to a 501c3 organization, an individual, a project, a religious organization or school, among other ideas listed in each winner’s essay). Approximate Retail Value (ARV) of the prize package is $1,300.
No substitution or transfer of prizes or cash redemptions permitted, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute for any reason whatsoever a prize (or portion thereof) of comparable or greater value, at their sole discretion. The Winners are responsible for the reporting and payment of all taxes (if any) or other costs and expenses associated with acceptance and use of a prize not specified herein.
GENERAL RULES AND REGULATIONS: By entering this Contest, Entrants grant Contest Entities and their designees the right, unless prohibited by law, to use their names, cities and states of residences, voices, pictures and likenesses, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Contest Entities and all matters related to the Contest, in any manner or medium, now or hereafter known, throughout the world in perpetuity. The contest sponsor will not sell participant information or use it beyond any means of promoting Kids Who Give, Farm Rich or Rich Products Corporation. In order for Entrants to participate, Entrants’ legal guardians must provide parental consent by checking permission on the online entry form. As the Entrant’s legal guardian, parents are also consenting to participation rules by checking their permission on the online entry form and agreeing to all rules and regulations addressed in this document.
Winners shall be required to execute an Affidavit of Eligibility, a Liability Release, a Tax Acknowledgment Form and, except where prohibited by law, a Publicity Release, and return those items within ten (10) business days of issuance of notification. Noncompliance within this time period or failure of a potential winner to respond to a notification attempt within ten (10) days of such attempt may result in disqualification and, at Sponsor’s sole discretion; an alternate winner may be selected. All prizes directed to Entrants who are considered minors will be awarded on the winners’ behalf to a parent or legal guardian who must sign all required documents. The payment of all applicable taxes including income taxes on prizes, and the determination as to whether or to what extent prizes are tax exempt, is the responsibility of the winners.
If: (i) any prize or prize notification is returned as undeliverable, (ii) a potential winner declines his or her prize, (iii) a potential winner fails to comply with any of the Official Rules as outlined herein, such potential winner will be disqualified and an alternate winner will be selected by the Judges, based on the Weighted Criteria, at the Sponsors’ sole discretion. With respect to each participant’s Submission, Entrants hereby irrevocably grant Sponsor, consistent with copyright ownership, the exclusive, perpetual, worldwide right to use the Video Essay, Written Essay and Submission materials, in whole or in part, alone or in combination with other material, or as a basis for new material, as Sponsor may determine in its sole discretion and for the purposes of advertising and promoting the Contest and/or the exhibitors thereof, and to use the Essay and/or Submission materials in connection with the Contest and related advertising and promotion or otherwise, but not as a direct endorsement for any product. Without limiting the generality of the foregoing, participants agree that the rights granted hereunder shall include, but not be limited to, the perpetual, worldwide right of Sponsor and their designees to use, edit, adapt, arrange, telecast, cablecast, rerun, record, publish, reproduce, license, print, distribute and/or otherwise exploit, in any language and in all media now known or hereafter devised, the Essay and/or Submission materials in whole or in part, without any further compensation to participant. Entrants may be required to execute any documents necessary to perfect such rights to the Sponsor. The Contest Entities expressly disclaim any responsibility, and Entrants agree to indemnify and hold harmless the Contest Entities from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Contest (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any of the prizes awarded (including any travel or activity related thereto).
